Hur's report made multiple references to how befuddled Joe was during questioning, unable to remember personal details of his life, often wandering off on random tangents and having to be reminded what the question was, showing general confusion, etc. The conclusion of Hur's summary reads:

So the question is, if the evidence really was lacking, then why not just say so and leave it at that? Why create this additional narrative that Joe is too far gone mentally to stand up to the rigors of a trial?

They dismissed it because they were not given a chance to authenticate it. And no one in their right mind would trust Giuliani or the NY Post to authenticate it.

How many stories do they report on that they themselves weren't able to personally verify? How many stories in any given newspaper consist of repeating what was reported elsewhere? There was no attempt to cover it fairly -- report on the contents as well as suspicions regarding them. Far too many, like NPR, simply deigned the story was unworthy of them covering it.

If a prosecutor does not believe there is sufficient evidence to convict, it's highly unethical to bring the case to trial. You're suggesting that Hur, despite understanding that he did not have a case to present that could reasonably result in a conviction, nevertheless should have sought prosecution.
