    Freddie Gray case: Hung jury in trial of Baltimore Officer William Porter

    It will be interesting to see if he is re-tried, and, if so, if that jury will also declare they are incapable of issuing a verdict.

    Since all 6 cops will have separate trials, this could have a pretty profound affect on the remainder of those trials.

    The first to state his case seems right until another comes and cross-examines him.

    That's what they get for insisting on trying the cases in Baltimore. They hoped thereby for a greater chance of conviction. Getting outside of Baltimore could have rendered acquitals, but they refused to risk that. Now they're stuck with hung juries. Some Blacks on juries will insist on conviction, and some Whites will refuse to punish cops for anything, and a reasonable verdict from sensible Blacks and Whites is rendered impossible. An impartial suburban jury would less likely have implacable Blacks and Whites and more likely enough moderates to get a conviction for something reasonable (not manslaughter, which might be reasonable except that punishments for manslaughter tend to be almost as harsh as for murder).

        Some of the legal experts are insisting that Baltimore picked the wrong cop to be "first". It sets a tone for the subsequent trials.
        The first to state his case seems right until another comes and cross-examines him.

          Especially since they planned on getting Porter to turn state's witness against the other officers starting with Caesar Goodson who IIRC was facing more severe charges and who's trial is scheduled to begin next month.

          Generally such a split decision (7 to 5) means prosecutors will not seek a retrial but I think that politics has been largely driving this case and will continue to do so meaning that they will probably ask for a retrial.

            I do think the misconduct and endangerment charges are warranted especially if they all neglected to do something, but then again, no one wants to set the precedent. But the right thing to do is never popular.

              Interestingly, according to a couple of the expert witnesses, at least in the case of Porter, it appears that he not only followed proper protocol he may have even went beyond it.

                From a legal and city management perspective, this thing has been handled disastrously from the gitgo.
