        U.S. District Judge James Peterson ruled earlier this month that Nicole Campbell’s Eight Amendment rights under the U.S. Constitution had been violated by the Wisconsin Department of Corrections when she was denied the surgery.

        The Eighth Amendment prohibits the federal government from imposing excessive bail, excessive fines, or cruel and unusual punishments.

        During Campbell’s trial in March, the court found she has gender dysphoria. In his ruling, Petersonwrote the condition causes Campbell "anguish and puts her at risk of self-harm or suicide."

        According to the American Psychiatric Association, gender dysphoria is "a strong desire to be of another gender, which may include desire to change primary and/or secondary sex characteristics. Not all transgender or gender diverse people experience dysphoria."

        In his ruling, Peterson acknowledged sexual reassignment surgery may be viewed as controversial, even outside a prison context, but said the surgery is no more expensive or difficult than other treatments DOC routinely provides.

        "And some members of the public are outraged at any effort to improve the health and well-being of inmates. But the true public interest lies in alleviating needless suffering by those who are dependent on the government for their care," Peterson said in his ruling.

        Campbell’s requests for breast augmentation, voice therapy, and electrolysis were denied by Peterson.

        In a brief filed in March, the Wisconsin Department of Justice argued sexual reassignment surgery was not medically necessary in Campbell's case because there was a dispute among experts whether it is appropriate for her.

        The brief also argued that Campbell has not had real life experience living among women. But in Peterson's ruling, he said Campbell will likely have to wait at least a year for the surgery, since there is only one qualified surgeon in Wisconsin able to perform the procedure. In the meantime, the DOC has the option to move her from the men’s prison in Racine to a facility for women, Taycheedah Correctional Institution in Fond du Lac County.

        Heneghan said Campbell prefers to be at Taycheedah.

        "She assumes, and probably correctly, her life will be easier there, because she will be with other women," Heneghan said.


        So it's not like this is just an arbitrary ruling. Assuming the court found correctly in the trial and the APA has the right picture of what gender dysphoria amounts to it's at least plausible that this was the correct ruling. This psychology aspect is just a wee bit outside my wheelhouse. I agree the inmate is a pervert but we shouldn't treat what might be a legitimate medical need differently depending on the nature of their crime.

            No. They send her to a woman's prison.

            I do not believe this is the right decision. I would be for it if it was just a question of allowing her to live as a woman, but plenty of biological males live as women without having surgery. I view this as cosmetic surgery, and I doubt that the state would pay for, say, a felon's nose job even if it was causing them significant distress to not have it.

            Of course, the felon's offence has nothing to do with the decision, abhorrent as I find it.

              If "she" has an X and Y chromosome then "she" is still a male regardless of PC doctrine and dogma. Putting a male rapist who says that he's a woman into a women's prison is needlessly endangering those locked up there. Even after "gender reassignment surgery" he is still a threat given some of the things he did to his daughter.

                I believe this to be an outright lie. There are PLENTY of excuses to shut down civics, and all you're doing is fueling the fire with this nonsense. Just stop.
                The first to state his case seems right until another comes and cross-examines him.

                          According to the criminal complaint against Campbell, the child victim told police that Campbell "had sex with her, masturbated in front of her, used various sex toys with her, and exposed her to DVD and video porn movies and magazines."


                          Remember the more than slightly controversial scene in the TV movie "Born Innocent" from the 1970s, which was set in a women's prison?

                              A few years ago I read something about a prisoner losing over 50 lbs. because he hated prison food as was used to expensive high quality meals. By this reasoning we should have been feeding him steak and lobster while he was incarcerated.

                              And if someone was suffering by being a man then why didn't they take steps to alleviate this before getting locked up, and making the taxpayers foot the bill?

                              Finally, considering the statistics on everything from suicide to severe depression of those who have sex change operations, were they actually alleviating needless suffering or merely supporting the P.C. agenda?

                                An appeal to emotion is not valid reasoning. It's that little dangly thing that got them into trouble, so I can see offering free castration.

                                But optional surgeries, and you want american citizens to pay for it? I don't think so.

                                If some gay group wanted to front all the money, including further treatments, I would consider it. And I don't think putting him around women is appropriate. Don't want to be around men, then be isolated.
