  • Louisiana law gets medieval

Good grief! I found this link on a site link that was provided by another contributor for a completely different topic.

If Sullivan who is already fifty four years old is being sentenced to a jail term of fifty years why the necessity to physically castrate him?

I also found the lead prosecutor's reference to using every "tool" the legislature has at its disposal a somewhat unfortunate term! .

This 2008 law is reminiscent of something one might expect to find in a novel set in a dystopian future. Margaret Atwood comes to mind!

A Louisiana judge has sentenced a man to physical castration after pleading guilty to raping a 14-year-old girl.

On April 17, District Attorney Scott Perrilloux said Glenn Sullivan, 54, was sentenced after pleading guilty to four counts of second-degree rape.

Louisiana Judge William Dykes on Monday sentenced Sullivan to be physically castrated along with serving a 50-year prison sentence.

Assistant District Attorney Brad Cascio told the press:

“I’ve had three people ordered to be chemically castrated, but, to my knowledge, this is the first physical castration to be ordered.”

Louisana enacted a law in 2008 that ordered convicted pedophiles to be castrated chemically or physically.

Dykes sentenced Sullivan to 50 years in prison and mandated him to be physically castrated as part of a plea agreement with prosecutors.

The lead prosecutor of the case, Assistant District Attorney Brad J. Cascio, said:

“I intend on using every tool the legislature is willing to give us, including physical castration, to seek justice for the children in our community.”

Given there are different "degrees" of castration, I gotta wonder which is meant here.

I'll wager he was looking at life with no chance of parole and now can get out in a few years, even arguing that he can no longer deemed to be a danger. Given that rapists, particularly child molesters do not have an easy time in prison, he figures its a trade he's willing to make.

It was part of a plea agreement which means that the defendant agreed to it.

Perhaps you would like them to be carried out in public as well? And make it a day out for all the family, just like in the "good old days".

I have no idea why a law with that punishment has been introduced into what is supposed to be a modern society.

Nor does this came seem to be much a plea bargain for the defendant. I am not entirely sure what concessions the prosecutor has made in exchange for Sullivan admitting his guilt, if physical castration is to be part of Sullivan's punishment.

Of course such medieval punishments are much cheaper than therapy. Nor was Sullivan technically a paedophile, his victim was fourteen years old

What will Louisiana's legislature introduce next? Perjurors and slanderers to have their tongues cut out? Thieves to have a hand or ear removed? Adulterers to have their lips and noses cut off?

From CBS - Sullivan had also groomed the victim and threatened her and her family to prevent her from coming forward.

Yes, that's exactly like a slanderer or a thief.

                        From USA Today -
On April 22, Judge William Dykes sentenced Sullivan to 50 years in prison and, in accordance with a plea deal, he agreed to be physically castrated, Perrilloux said.

And, more from CBS 19, Charlottesville...

In addition to his 50-year prison sentence, Sullivan must be physically castrated within one week of his release.

Brad Cascio, the local assistant district attorney, said he pushed for the sentence due to the severity of the case.

"I felt that this case was a strong enough case and warranted such action," he said.

Men convicted of certain rape offenses in Louisiana may be sentenced to chemical castration, or, if they so choose, the surgical removal of their testicles. Sullivan chose the latter.

From this account, the surgical castration appears to be required within a week of his release from his 50 year prison term. Perhaps that's why he agreed - it ain't never gonna happen.
Also, from this account, it was his choice.

I made no comparison between slandering or thieving. I posed a question about the Louisiana legislature introducing equally barbarous punishments for those offences.

That the crime is horrendous is not in doubt but the punishment is rather "medieval" even with the consent of the defendant.

And of course as I also previously observed such punishments are so much cheaper than organising long-term therapy with a qualified psychiatrist for such individuals.

You would be right in that assumption, unless he gets his sentence reduced it will not happen. However, that does not remove the barbarity of such a potential punishment.
