    9th Circuit rules against reinstating travel ban

    (CNN)President Donald Trump's travel ban will remain blocked, a federal appeals court ruled Thursday.

    The ruling means that citizens of seven majority Muslim countries will continue to be able to travel to the US, despite Trump's executive order from last month.
    The order bars citizens of Iraq, Syria, Iran, Libya, Somalia, Sudan and Yemen from entering the US for 90 days, all refugees for 120 days and indefinitely halts refugees from Syria.
    Trump issued the travel ban on January 27, causing chaos, confusion and protests at international airports as the legal status of people in transition was suddenly thrown into question. Lawsuits have been filed across the country, but it was one from federal Judge James Robart in Seattle last Friday that blocked the travel ban nationwide, clearing the way for resumed travel from the seven countries.

    It became obvious when their questioning rapidly veered from discussing the law itself that the most liberal federal court in the country, who's decisions are typically overturned by the Supreme Court (80% of the time!), was going to make that decision.

      I am thankful for the decision. The ban is doomed anyway, because it is based on a strong religious prejudice against Muslims reinforced by citations from Trump.

        Please provide an exact quote from the executive order where it institutes a religious test.

          They looked through political rhetoric in the middle of a hotly contested campaign and not the law to justify what they had already decided upon.

              Rudy Giuliani openly admitted it was intended to be religious in nature. David French has some good commentary on National Review about how the administration shot themselves in the foot and most likely could have legally succeeded.

                    4-4 or 5-3 or 6-2 or decline to hear? I could almost see Roberts and Kennedy going with Ginsburg, Sotomayor, Breyer, and Kagan. I could also see them being impish and declining to hear the stay. In my ignorant and untutored opinion on such weighty matters, I put the ranking of the odds like this:

                    Most likely:
                    • Decline to hear until there is a ninth justice 'cuz Congress ain't the only ones who can be obstructionist. Also, Trump and the baboon pack can try again when there are nine justices.
                    • 5-3 Against (Kennedy with libs)
                    • 6-2 as a rebuke to the executive for slamming the judiciary. (Roberts goes rogue sometimes.)
                    • 4-4 for (Kennedy with Roberts, Alito, and Thomas) I don't think anyone wants this to happen because A.) waste of time B.) same outcome as decline to hear.
                    • 8-0 for the executive through either Bannon's blackmail or the body-snatcher dopplegangers taking over.
                    • They can't decide amongst themselves so they call up guacamole and they're like, "Senor, can you take a break from your duties as president of Mexico and give us some ideas?" and after my wise--some might say 'supernatural'-council, they rule against the executive and also rule to return Aztlan to its rightful owners... the Chinese.

                      as you said this court has had 80% of its' rulings overturned and this ruling shows why. They keep overstepping thier bounds. They are known as the 9th Circus Court for a reason as this ruling shows.

                          Giuliani can say whatever he wants. It's a free country. What matters is what the order itself actually says, and it does not impose a religious test nor does it violate or supersede existing law.
