Several sources are indicating that New York's governor Andrew Cuomo is on Biden's short list for being his Attorney General, a job who's duties include, as spelled out in the Judiciary Act of 1789, "giv[ing] his advice and opinion upon questions of law when required by the president of the United States, or when requested by the heads of any of the departments."
On Tuesday of this week Cuomo signed into law legislation that prohibits the sale of Confederate flags and other "hate symbols"[1] on public property, including at state and local fairs. While arguing whether or not this is a good thing is an entirely separate issue (and as the OP I ask that this thread not devolve into), Cuomo did so while openly acknowledging that his action is in violation of the Constitution's First Amendment.
In normal times such an action would be an immediate disqualifier for being selected as Attorney General. And given that Cuomo has apparently indicated that he really isn't interested in being AG, maybe this is his way of insuring he isn't picked. It would be one way to avoid a Senate confirmation hearing sure to raise numerous issues that Cuomo would prefer to keep out of the limelight and public scrutiny.

Keep in mind that we live in an era where simply giving the "OK" sign with your hand (touching the tips of your thumb and index finger together thus forming a circle with them), a gesture symbolizing that every thing is fine that stretches at least as far back as the early 17th century, is deemed as a symbol of white supremacy and a "hate symbol"
