    Judge: Washington Florist Who Refused Gay Wedding Broke Law

    RICHLAND, Wash. — Feb 18, 2015, 9:12 PM ET

    A florist in Washington state who refused to provide flowers to a gay couple for their wedding violated state consumer protection and anti-discrimination law, a judge ruled Wednesday.

    Benton County Superior Court Judge Alex Ekstrom rejected arguments from the owner of Arlene's Flowers in Richland that her actions were protected by her freedoms of speech and religion. While religious beliefs are protected by the First Amendment, actions based on those beliefs aren't necessarily protected, he said.

    "For over 135 years, the Supreme Court has held that laws may prohibit religiously motivated action, as opposed to belief," Ekstrom wrote. "The Courts have confirmed the power of the Legislative Branch to prohibit conduct it deems discriminatory, even where the motivation for that conduct is grounded in religious belief."

    The organization argues that Stutzman did not discriminate against Ingersoll and his partner Curt Freed, as she had served Ingersoll numerous times in the past. Additionally, the firm claims that it is improper to personally hold Stutzman liable.

    Barronelle and numerous others like her around the country have been more than willing to serve any and all customers, but they are not willing to promote any and all messages,” Alliance Defending Freedom attorney Kristen Waggoner said, according to the Christian Broadcasting Network.

    She added, “A government that forces any American to create a message contrary to her own convictions and surrender her livelihood is a government every American should fear.”

    That's weird, because the 1st Amendment does not explicitly protect beliefs, but it does explicitly protect action thereof: the "free exercise" of religion.

    I also note that things like flowers for weddings are often purchased by someone other than the couple getting married. Hypothetically, if the purchaser had been the straight parents of one of the men, presumably the florist would still have refused, for the same reason. But surely the purchasers in that case couldn't sue for discrimination based on their sexual orientation (which is straight).

      Right, and this was a commissioned work. I thought, according to Sam, that that was protected work.

        Well, Sam would say that it's commissioned work only if something about the requested flower arrangements was homosexual-specific, and not just a "vanilla flower arrangement package".

        On the other hand, when it was pointed out that (in the bakery case) there were to be same-sex figures on the cake and the writing on the cake indicated the same, Sam shifted and said that those were too trivial of changes on the cake and it has to be a more significant difference in the product to make it not a "vanilla good". But Sam said that writing a pro-gay message on a t-shirt would be significant enough content to make it not "vanilla". So it's not completely clear where Sam draws the line on this.

          She is fighting back!

          A Christian florist who was sued and found guilty of discrimination after refusing to provide flowers for a same-sex wedding isn’t planning on backing down, recently issuing a defiant letter rejecting a settlement agreement and revealing plans to appeal her case.

          After Barronelle Stutzman, 70, declined a $2,001 settlement offer in a letter to the state’s attorney general on Friday, her attorney, Kristen Waggoner, senior counsel of the Alliance Defending Freedom, a conservative legal firm, told TheBlaze on Monday that a judge’s decision that Stutzman violated anti-discrimination law will be challenged in the state court system.

          As previously reported, Benton County Superior Court Judge Alex Ekstrom decided last week that Barronelle Stutzman violated Washington’s Law Against Discrimination and Consumer Protection Act when she refused service to Robert Ingersoll and his partner, Curt Freed.

          The state subsequently offered a settlement in which Waggoner would only need to pay a $2,000 fine and $1 in legal fees and commit to offering flowers for gay and straight weddings, alike, if she continues providing matrimony services, the Daily Mail reported.
