            He seems to be the first to try to abuse it on such a vast scale. There have been presidents previously who have tried to hide their sins behind it, but Trump seems to be taking obstruction of justice to a whole new level with it.

A favourite tactic of his is to litigate until the other fellow gives up or runs out of money. I think Congress can keep it up as long as he can. Pelosi has enough to work with even though he is blocking the production of evidence. The public, except the base, are amazed by the level of brazen criminality of this POTUS. He is definitely one of a kind.

                      Probably. Democrats have already said as much, even though in this case, they're twisting the meaning of "obstruction of justice" in order to condemn an innocent man who is simply trying to defend himself against false accusations.

                      Here's Democrat "justice" for you: "We find the defendant guilty and sentence him to life in prison! We now call the defense to present their case."

                        A) the Democrats have to come up with AoC they can actually sell to the American public.
                        2) they have to get enough representatives in the House to vote FOR impeachment to move to the Senate
                        c) that means they will probably have to get major support from the American public, and that's just not changing
                        D) even IF it goes to the Senate, a snowball has a better chance of surviving the hot place.
                        The first to state his case seems right until another comes and cross-examines him.

                          Upon reflection, I actually prefer NorrinRadd's explanation on the first page to my own.

                            The nightmare scenario for Democrats is they successfully impeach Trump in the House, but he is acquitted after an open trial in the Senate. This is why Democrats are now testing the idea of a censure instead, so their case against the President is never put to the test, and they can go into the 2020 campaign with the false narrative that the evidence against Trump is overwhelming and conclusive, even if unproven.

                              Because they know full well that a trial in the Senate will not convict, and Trump will then run on "I have been EXONERATED", which, while technically incorrect, will work quite well for him.

                                On Oct. 17, 2006, President George W. Bush signed a law suspending the right of habeas corpus to persons "determined by the United States" to be an "enemy combatant" in the Global War on Terror.


                                Bush's action drew severe criticism, mainly for the law's failure to specifically designate who in the United States will determine who is and who is not an "enemy combatant."


                                'A Time of Shame This Is'
                                Jonathan Turley, professor of constitutional law at George Washington University, objected to Bush's support for the law—the Military Commissions Act of 2006—and its suspension of writs of habeas corpus. He stated,

                                "What, really, a time of shame this is for the American system. What the Congress did and what the president signed today essentially revokes over 200 years of American principles and values."

                                Not the First Time

                                The Military Commissions Act of 2006 was not the first time the Constitution's guaranteed right to writs of habeas corpus was suspended by an action of a president.

                                In the early days of the U.S. Civil War President Abraham Lincoln suspended writs of habeas corpus.

                                Both Bush and Lincoln based their actions on the dangers of war, and both presidents faced sharp criticism for carrying out what many believed to be an attack on the Constitution.

                                No, the South has a pretty favorable opinion of Lincoln. Habeas corpus applied in the North and the occupied states.
