Its not a case of whether it is legal but whether it is ethical or appropriate.

The executive powers granted to the president are not bound by law due to the separation of powers. Law is a legislative power given by the constitution same as the executive powers. A power is only answerable to a greater power so they tie.

The president is under the law as a citizen but in his exercising of the executive powers he is above the law. This is what Uncle Ben was talking about when he said ‘with great power comes great responsibility’. The president is entrusted with these powers with the condition that they would be only used for the people.

So to answer your question, it’s ‘legal’ if it was done for legitimate reasons.

Um, no. The Constitution itself is law - the supreme law of the land. The president is not above the law and laws that deal with appropriations are Congressional powers and therefore binding on the Exec so long as they are themselves constitutional.

I'm inclined to agree with you about legitimacy of purpose. But it's not a good argument for the current issue. The Democrats are clearly not acting in good faith, they have not made a compelling case and they are not going to convince the public without a solid case built on strong evidence at this point. It's political suicide now even though it might be legitimate in a better case.

Yes the constitution is law. I'm using law to mean legislative power here.

The president is above the law when it comes to executive power because its vested in the president by the constitution. Executive powers and the president are not the same, congressional powers can bind the president but it can't limit restrict or have any effect on executive powers.

What do you think of Trumps behavior regarding these proceedings?

Aren't the polls showing 50% of Americans want Trump impeached and removed?

This probably should be its own thread.

            A) First of all, it's a poll, and
            2) it depends on when and how the question was framed, and
            3) our nation is not a nation of polls, which would be a democracy, but a representative republic.

Our form of government was intended, in part, to keep from constantly responding to "the will of the people", who can be quite fickle.

An more interesting poll might include a third option --- that the President be impeached and censured, but not removed.

In fact, a more recent poll shows that support for impeachment has actually dropped.

Support for impeachment drops after second week of hearings: Poll

Two weeks of impeachment-related hearings have left the country divided over whether President Trump should be pushed from office, a new poll shows.

The Quinnipiac University poll, released Tuesday, found support for the president’s impeachment had dropped from 48% in late October to 45% a month later. The poll surveyed 1,355 registered voters from Nov. 21-25, with a margin of error of +/- 3.2 percentage points.

            So much for polls.

No, the significant fact here is that 50% of the American public want him gone. It is a horrible statement about his presidency. When was the last time 50% of the country believed a president had done something so bad he needed to not only be impeached, but removed.

                • Well, lookie there!!!! It's right there in Article II, Section 4 of the Constitution of the United States....

The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors -- OR if 50% or more of Americans think they should be impeached and removed, then throw the bum out!!!

No matter who is in the White House, it is typical that roughly half of all voters want him gone. Trump isn't unique in that respect.

In Trump's case the polls are probably even more inaccurate because they're undoubtedly a lot of undercover Trump supporters that won't openly admit it because of the stigma. Folks that are polled about that probably don't even have a clue why he's being impeached, but they know that it's just the proper societal etiquette (and also fear of not getting physically attacked) to say you hate Trump.

There's also the fact that a plurality did not want Trump elected in the first place.

If there were an "electoral college" sort of filter applied to the polls, the results might be quite different.

But the news told me that no president got over the mid 30% mark. At least trump won’t need to exaggerate for this record, if it’s true of course.

And polls regarding issues that those taking the polls have taken a side on have proven notoriously inaccurate. Look at Brexit and the 2016 presidential election for examples. At least here in the U.S. nearly every major polling firm has partnered with a MSM news outlet whether it be the New York Times, WaPo, ABC, CBS, NBC... and the latter spent a lot of time telling voters how only a moron would even consider voting for Trump, so it should come as no surprise that a substantial number of those polled lie to them.

If that were true then there would never have been a president who ran for re-election and lost. All of them had over 50% of the voters wanting them gone.
