    Intelligence Oversight
What the Latest Reports Say About the Whistleblower Complaint
    Robert S. Litt
    Fri, Sep 20, 2019, 4:17 PM
If the speculation is accurate, the actions by the Office of the Director of National Intelligence may have a firmer legal foundation than has so far been apparent.
As I outlined here, the Intelligence Community Whistleblower Protection Act provides that if the ICIG determines that a complaint about a matter of “urgent concern” is credible, he sends it to the DNI, who within seven days “shall ... forward” it to Congress together with any comments. But a matter of “urgent concern” is defined as “a serious or flagrant problem, abuse, violation of law or Executive order, or deficiency relating to the funding, administration or operation of an intelligence activity within the authority of the Director of National Intelligence involving classified information” (emphasis added). The alleged offer by the president, while perhaps criminal and possibly impeachable, does not obviously relate to any intelligence activity within the DNI’s authority.

    Bio sketch:
Robert Litt formerly served as the General Counsel to the Office of the Director of National Intelligence under the Obama administration.

Which sounds more compelling to you, and indeed more supportive of your position, a defense of the ODNI withholding from the prior GC under Obama, or a hyperpartisan screed telling you not to pay attention to him?
You're right, I'm sure it's just a coincidence that members of Lawfare are exclusively liberal and have been hired by and work closely with members of the Democrat party to push their liberal agenda through backroom deals instead of openly in the halls of government.

After the 2018 mid-terms, and in preparation for the “impeachment” strategy, House Intelligence Committee Chairman Adam Schiff and House Judiciary Committee Chairman Jerry Nadler hired Lawfare Group members to become committee staff. Chairman Schiff hired former SDNY U.S. Attorney Daniel Goldman, and Chairman Nadler hired Obama Administration lawyer Norm Eisen and criminal defense attorney Barry Berke, all are within the Lawfare network.

    ...

Under Eric Holder, Sally Yates, Loretta Lynch, Tom Perez, Robert Mueller, James Comey and Andrew McCabe, the focus of the DOJ and FBI became prismatic toward politics and tribalism. All of the hired senior lawyers and officials had to be aligned with the political intents of the offices.

Their agencies were used against their ideological enemies in large operations like Fast-n-Furious, IRS targeting, Gibson Guitar etc. And also smaller operations: Henry Louis Gates, George Zimmerman, Darren Wilson, Ferguson, Baltimore etc. All of these activist Lawfare examples were pushed and promoted by an allied media.

Many of the ‘weaponized’ approaches use radical legal theory (ex. disparate impact), and that ties into the purposes and methods of the Lawfare Group. The intent of Lawfare is described in the name: to use Law as a tool in Warfare. The ideology that binds the group is the ideological outlook and purpose: using the legal system to target political opposition.

The Lawfare group ensures you have the right to remain guilty until they verify your politics and determine your alignment with the tribe. If accepted, your disposition shifts to innocent and you receive a pass to avoid any legal jeopardy…

As for the "whistleblower", it seems whoever blew the whistle didn't have the whole story. He allegedly heard one conversation between President Trump and the Ukrainian president but apparently didn't realize that it was, in fact, the final push of a two-year effort by Ukraine to get the US government to finally look into the possibly illegal activities of Creepy Joe and the Democrat party.

Apparently in the phone call, President Zelensky was explaining what action the Ukranian government had already taken to try and get the information about corrupt U.S. officials, including former VP Joe Biden, to the U.S. government.

It was from this clarification of information that President Trump is reported to have told Zelensky it was OK to proceed with any internal investigation of corruption in Ukraine that might also encompass former U.S. officials. Yes, that would include Joe Biden.

From this context we can see how the “whistle-blower”, knowing only half of the information – might incorrectly perceive the conversation. Additionally, there’s a possibility the “whistle-blower” may be ideologically aligned with the same government entities that were trying to block the Ukrainian government from delivering the information in the first place.

Why do you think Hunter Biden was asked to be a board member? What special knowledge or expertise did he have? What could he contribute to the board?

What I think or you think is irrelevant to the issue. I don't know anything about Hunter Biden, his education or background. The point is he wasn't being investigated, the company he was employed at was and the investigation was apparently shelved before the Obama administration even threatened to withhold aid. What do you have on Hunter Biden, anything? I didn't think so!

And for $50,000 a month, which was nearly a third of the overall fee paid to his firm!

            Actually....

Interviews with a half-dozen senior Ukrainian officials confirm Biden’s account, though they claim the pressure was applied over several months in late 2015 and early 2016, not just six hours of one dramatic day. Whatever the case, Poroshenko and Ukraine’s parliament obliged by ending Shokin’s tenure as prosecutor. Shokin was facing steep criticism in Ukraine, and among some U.S. officials, for not bringing enough corruption prosecutions when he was fired.

In subsequent interviews with Ukrainian officials, however, they related something to Solomon they say Biden no doubt knew when he issued his ultimatum: The prosecutor who was fired was leading a far-reaching corruption probe into Burisma Holdings, a natural gas firm that just happened to employ Biden’s son, Hunter, as a board member.

Solomon noted that, according to banking records, Rosemont Seneca Partners LLC, Hunter Biden’s U.S. firm, “received regular transfers into one of its accounts – usually more than $166,000 a month – from Burisma from spring 2014 through fall 2015, during a period when Vice President Biden was the main U.S. official dealing with Ukraine and its tense relations with Russia.”

Problem is, you got nothing, MM, but more obfuscation from the Trump mob.
And yet the Ukrainian government thought the whole thing sketchy enough that they have been trying for two-years to get the US government to look into it, even taking the extraordinary step of hiring a private lawyer from the US to hand deliver documents and evidence to federal prosecutors!

So, the question remains -- would Bursima have even accepted a resume from Hunter Biden if his dad wasn't VPOTUS? Not a snowball's chance in the hot place.

And pray tell, what does what Hunter Biden was paid have to do with anything?

                        False.

“We’ve talked before about the deals he procured with the government for China,” remembered Schweizer. “The other place [Joe Biden’s] son, Hunter Biden, procured a big deal was in Ukraine. In Ukraine, it involved an energy company called Burisma, which is a very corrupt organization headed by an oligarch named Mykola Zlochevsky who is very close to Viktor Yanukovich, the pro-Russian leader.

Schweizer then asked: “There’s all kinds of questions and implications. Is there a Russian component to this, because Burisma is such a corrupt company?”

“The bottom line is Joe Biden was the Obama administration’s point-person on policy towards Ukraine,” noted Schweizer. “He steered $1.8 billion in aid to that government and while he was doing so, his son got a sweetheart deal with this energy company – that we’ve been able to trace over just a 14-month period – paid $3.1 million into an account where Hunter Biden was getting paid.”

As to your ignorant ramblings about "this is Ukraine, not Russia"....

The editor-at-large also pushed back against any allegations that POTUS Donald Trump ‘colluded’ with Russia. If anything, he says, it was the Bidens and the Clintons conspiring with foreign governments, Russia included.

Laughing. It's not just "what he was paid", but WHY he was paid it, Jimmy. They were buying the influence of his father -- Hunter had ZERO experience or expertise to serve on that board. That's the "corruption" you pretend to hate.

Hunter Biden was a partner and co-founder of his own company, Rosemont Seneca Partners LLC. How do you know who would and who wouldn't do business with them?

                              • And this....

“There is far more evidence of collusion involving Joe Biden — or even involving the Clintons — of collusion with these foreign powers than there was with Donald Trump, because you actually have the transaction of money, you have very favorable policies that were carried out. I think ‘collusion’ is not too strong a word. I think it’s a pretty accurate word,” he said.

Schweizer added, “There’s no question. The Bidens got a lot of money — millions of dollars — from these foreign powers. Hunter Biden had no legitimate reasons to get the deal. He simply wasn’t qualified.”

In all, Solomon adds, Ukrainian officials believe some $3 million made it into the accounts of Hunter Biden and Archer, his partner. And while everyone is innocent until proven guilty, Joe Biden needs to answer some hard questions about this if he decides to run.

Again I ask, Jimmy, what was Hunter Biden's qualification for he and his buddy to be getting boatloads of money for.... what? You can't produce a SINGLE REASON showing they were qualified, which is why you play this ignorant game....
