    A father complained to the school board about them assigning a book to his 14 year-old daughter to read that contained sexually explicit scenes in it. He got arrested for his trouble.

    He was arrested for disorderly conduct, which might well have been the case. It's a separate issue from "is the assignment of such books appropriate"?

        Really? What was the "disorderly conduct?"

              He was arrested for the trumped up charge of disorderly conduct because he broke an arbitrary rule that said he could only talk for 2 minutes and not ask any questions. He was told he needed to talk to the principal, which he did, who referred him to talk to the board. round and round it goes. If some bureaucracy doesn't allow any discussion by playing games and making up rules, then a person has a constitutional right to protest and speak out. Especially when it comes to the welfare of his children.

              a 2 minute rule with no questions is arbitrary and laughable.
              They might as well make a rule saying "anyone who disagrees with us will be held in contempt and arrested"


              Now if he were threatening them with violence, tossing around books and so on, then yes, he would be in violation of disorderly conduct. But people can't just make up arbitrary rules and enforce them with police without a law in place. Unfortunately many places use "disorderly conduct" to be a catch-all to basically arrest someone for no reason at all. I don't know what Gilford's law states on the matter.

                        Can you establish that the rule was 'arbitrary', which would mean that it was not a rule normally in place to govern the proceedings?

                              I am not sure how your law would consider 'disorderly conduct'. But if I take the commonsensical understanding, the 2 minute rule appears to be an agreed upon way of managing such meetings, creating order instead of the dozens of parents shouting over each other to be heard. Insofar as he is violating the rule repeatedly it is clear that he is behaving in a disorderly fashion. As to whether the policeman has the jurisdiction to intervene I am uncertain.

                              And please, before the , this doesn't mean I support the book assignment policy, or how the school board conducts such meetings.
