    In a presidential system what you say would make sense, but not in a parliamentary one. It is standard for leaders to leave several months before the election that they don't want to stand in. It gives their successor time to get used to the leadership role. About now is the standard time for resigning for someone in her position not planning to run in the next election.

    I believe her claims that she feels burnt out and doesn't want to run for another 3 years of leadership. But the other major piece of relevant information is that polling has been showing fairly consistently that she was going to lose in the next election. Better to pretend she's leaving of her own choice than to stand again and then lose.

      Note the word "knowingly" in the text of the law.

      Carelessness is I took it home without thinking and brought it back the next day. I would think having it in your possession for six years makes a "I was careless" defense harder to be convincing.
      If it's not clear that he knew it was there, then the duration isn't relevant.

      Also, the statue talks about storage in an unauthorized location. Not sure if Penn Biden or his home between when he was Vice-President and President would count.
      I'm sure that if they were authorized locations, we would know it by now.

        We don't know right now that it was Biden who was careless. It could have been one of those people who were supposed to make sure that such things don't "just happen".

        But whoever it was, I think he can get away with it, unless it's possible to show it was intentional.

          Knowing Biden's deteriorating mind, I suppose it's possible he didn't notice classified papers sitting next to his Corvette for 6 or 7 years. Of course, since he's coherent enough to drive he should be noticing his surroundings.

              Former US president Donald Trump and one of his lawyers have been sanctioned by a Florida judge – who ordered them to pay almost one million US dollars (Ł810,000) for what he said was a bogus legal claim against Hillary Clinton and others.

              Donald M Middlebrooks accused Mr Trump of a “pattern of abuse of the courts” by filing frivolous claims for political purposes, which he said “undermines the rule of law” and “amounts to obstruction of justice”.

              He wrote in a ruling: “Here, we are confronted with a lawsuit that should never have been filed, which was completely frivolous, both factually and legally, and which was brought in bad faith for an improper purpose.”

              Citing his recent legal action against the Pulitzer Prize board, New York attorney general Letitia James, big technology companies and media giant CNN, Mr Middlebrooks described Mr Trump as a “prolific and sophisticated litigant” who uses the courts “to seek revenge on political adversaries”.

              He wrote: “He is the mastermind of strategic abuse of the judicial process.”

                Oh I think he will get away with it too. Because he's a democrat. But I also think that if he does, it will be impossible to convict Trump of his similar problem. Biden is giving Trump a get out of jail free card.

                  The documents do. Classified documents are supposed to have a cover on them marked "Classified" in big red letters. Whoever boxed up his office would have to have seen that surely.

                    No, people lose their security clearances for being careless. They go to jail for intentionally mishandling classified documents, or by trying to cover up their mistakes by destroying evidence or lying to investigators.

                      The post I was responding to suggested that Biden should have noticed the classified documents in his garage. Forgetting that they were in boxes not marked classified.

                        Yeah, let's conveniently overlook them being found in other locations like in his office at Penn State and scattered about in his personal private library.

                          If you would read those two articles, you would see that they are both about Asia Janay Lavarello, and that she was aware that she had those classified documents, and "... Lavarello made false statements to the Federal Bureau of Investigation and the Naval Criminal Investigative Service in response to questioning about her handling of the classified material."

PHO knew that he was not authorized to remove National Defense Information and classified documents and writings from secure locations and was not authorized to retain them at his residence. PHO willfully and unlawfully retained documents and writings that contained National Defense Information, including classified documents and writings, which were classified as TOP SECRET and SCI.


                          The software may have leaked accidentally, but it was taken deliberately.

                          Kristian Saucier got a jail sentence because he obstructed the investigation:

                          The investigation began in March 2012 when Saucier’s cellphone was found at a waste transfer station in Hampton, Connecticut. Saucier was interviewed by the FBI and Naval Criminal Investigative Service (NCIS) in July 2012 and was confronted with the classified images from his phone. Following that interview and in an effort to impede the federal investigation, Saucier returned to his home and immediately destroyed a laptop computer, a personal camera and the camera’s memory card. Pieces of a laptop computer were subsequently found in the woods on a property in Connecticut owned by a member of Saucier’s family.

                            AFAIK NZ has never before had a ginger-haired PM.

                            This also means that the leaders of the two major parties are now both named Chris.

                            I don't really know much about the guy, but he has a reputation for being personable and competent. Amusingly during one of the covid briefings a couple of years ago he misspoke and encouraged the nation to take walks for exercise by using the idiom "stretch your legs", but misspoke and said "spread your legs" instead, an idiom for something a bit different. Someone took the opportunity to start printing mugs with his picture and the words "spread your legs". He took the joke well and turned up to the next covid briefing carrying one of those mugs to drink from.
