    Trump can now claim special prosecution based on the Democrats' fear of his potential Presidency.


    WASHINGTON — Attorney General Merrick Garland has named a special counsel on Friday to oversee the Justice Department’s investigation into the presence of classified documents at former President Donald Trump’s Florida estate as well as key aspects of a separate probe involving the Jan. 6 insurrection and efforts to undo the 2020 election.

    The move, which is being announced just three days after Trump announced his 2024 candidacy, is a recognition of the unmistakable political implications of two investigations that involve not only a former president but also a current White House hopeful.


    The first to state his case seems right until another comes and cross-examines him.

    I was unable to read the article, but I would assume Garland would credit the timing as his not wanting to interfere in the elections.

      There was no immediate reason provided for the decision or for its timing. Garland has spoken repeatedly of his singular focus on the facts, the evidence and the law in the Justice Department’s decision-making and of his determination to restore political independence to the agency following the tumultuous years of the Trump administration.

        I have a really hard time not thinking unChristian thoughts regarding Garland --- I wish he would be 1/10th as interested in the Southern Border as he was in Trump.

        And, yes, he's just now saying it's because Trump announced, that he feels the need to move forward now.

        Trump will absolutely love this.

          So, he's naming Jack Smith as special prosecutor.

          From 2018.... US PROSECUTOR JACK SMITH APPOINTED SPECIALIST PROSECUTOR


          Jack Smith, a US prosecutor with experience in both high-level political investigations and international criminal investigations, has been appointed Specialist Prosecutor after a selection process organised by the European Union.

          He will be succeeding David Schwendiman, the first Specialist Prosecutor and formerly Lead Prosecutor of the Special Investigative Task Force, who stepped down at the end of March when his term as a US Foreign Service Officer expired.

          “I am honoured and delighted to have been given this challenge and am looking forward to taking the investigation forward,” Mr Smith said.

          Mr Smith is currently Vice President and Head of Litigation for the Hospital Corporation of America, the largest non-governmental health-care provider in the United States, a position he has been in since September 2017.

          Between February 2015 and August 2017, Mr Smith served as First Assistant United States Attorney and Acting United States Attorney for the Middle District of Tennessee.

          Between 2010 and 2015, Mr Smith served as Chief of the Public Integrity Section of the US Department of Justice, supervising the litigation of complex public corruption cases across the United States.

          From 2008 to 2010, Mr Smith served as Investigation Coordinator in the Office of the Prosecutor at the International Criminal Court (ICC). In that capacity, he supervised sensitive investigations of foreign government officials and militia for war crimes, crimes against humanity, and genocide.

          Mr Smith joined the ICC from the US Attorney's Office for the Eastern District of New York, where he served for nine years in a number of positions, including Chief of Criminal Litigation and Deputy Chief of the Criminal Division. As Chief of Criminal Litigation, Mr Smith supervised approximately 100 criminal prosecutors across a range of programme areas, including public corruption, terrorism, violent crime and gangs, as well as white collar and complex financial fraud.

          Before becoming an Assistant US Attorney, Mr Smith served for five years as an Assistant District Attorney in the New York County District Attorney's Office where he was a member of the Office's Sex Crimes and Domestic Violence Units.

          Mr Smith has received a number of awards during the course of his career. These include the US Department of Justice Director's Award; the US Attorney General's Award for Distinguished Service; the Federal Bar Association's Younger Federal Attorney Award; the Eastern District Association's Charles Rose Award; the Henry L. Stimson Medal of the New York County Bar Association; and a Harvard Law School Wasserstein Fellowship.

          He is a graduate of both Harvard Law School and the State University of New York at Oneonta.

                Or 1/10th as interested in investigating the Biden Crime Family for which there is substantial evidence.

                The whole point of all of this is to stop Trump from being able to publicly release the evidence that implicates Obama, Hillary, Joe, and all the rest in the Russian Collusion Delusion. First it was Mueller, then Durham, and now Smith. Legally, Trump can't release the documents as long as they're the subject of an investigation, and the Democrats plan to keep them under investigation for as long as they possibly can.

                  Seems to me like a very good time to set a special council, when a man who stole documents from the white house when he left it is announcing an attempt to return to the white house where he can steal even more.

                      At this point, I'm beginning to think they actually want Trump to run and win the nomination. I can't imagine they're this clueless to think this will achieve anything other than lift his stardom and help his election. If they really wanted to take him down, they would have just charged him with something and arrested him already like they've been blustering on about for 6 years. Maybe I'm just grossly underestimating their derangement, and if I am, then these folks are truly insane.

                        Geraldo Rivera made an interesting point --- they already impeached him on much of the same stuff they're going to include in this new investigation, so a criminal trial would be akin to double jeopardy. Who knows.

                            Special counsel. (And, earlier, I called him special prosecutor, but I think he's gonna operate more in the role of prosecutor than counselor)

                              I was wrong. This rabbit hole goes a lot deeper than I realized. Trump is the secondary target despite all the media focusing on that angle of the story. The real intent of Garland appointing Smith is to kneecap the incoming Republicans:

                              The overarching Lawfare framework has been transparently created by President Obama’s former White House Legal Counsel and current U.S. Asst Attorney General Lisa Monaco. To wit, earlier this afternoon Joe Biden’s Attorney General, Merrick Garland, announced the appointment of DOJ Attorney Jack Smith as special counsel to investigate two specific areas:
                              • First, to investigate current republican members of congress (House and Senate), former President and current candidate Donald J Trump, former Trump administration officials, former White House staff, and other individuals, groups and organizations for their role in supporting an insurrection on January 6, 2021, against the incoming administration of President-Elect Joe Biden. In essence, the J6 investigation – with an emphasis on congress – transfers to Special Counsel Jack Smith:
                              The Special Counsel is authorized to conduct the ongoing investigation into whether any person or entity violated the law in connection with efforts to interfere with the lawful transfer of power following the 2020 presidential election or the certification of the Electoral College vote held on or about January 6, 2021, as well as any matters that arose or might arise directly from this investigation or that are within the scope of [Special Counsel Regulations 28 C.F.R. 600.4(a)].                               This is an extension of the January 6th Committee special investigation that transfers the committee’s investigative findings, ie phone records, text messages, transcripts, emails, prior testimony and all evidentiary records, into the newly appointed Special Counsel.

                              As you can see from the simple (non-pretending) explanation of what is being done, the lawfare process become clear. Everything congress may now begin to question falls under the protective blanket of an “ongoing investigation,” exactly as we predicted. Plus, you get the additional Lawfare elements of congressional leadership under investigation which provides an entirely new ‘conflict of interest dynamic’ to the political equation.

                              Then you have the congressional representatives under investigation and search warrants on their phones, text messages, emails, etc…. AND the added benefit of using DOJ-NSD defined terms of “national security threat” to gain FISA warrants on an entire incoming congressional delegation. How slick is that?

                              That means no holding Pelosi's J6 committee accountable. That means no investigating Joe and Hunter. That means no holding Garland accountable for his corruption and dereliction of duty. Basically, all the things we were hoping from a Republican controlled House has now been put on ice.

                              Then, of course, there's the secondary Trump angle:

                              • Second – and this is ancillary to the first priority – DAG Lisa Monaco has written, and AG Garland has appointed, Jack Smith to target Donald Trump with the same special counsel process previously used by Robert Mueller and Andrew Weissmann.
                              The Special Counsel is further authorized to conduct the ongoing investigation referenced and described in the United States’ Response to Motion for Judicial Oversight and Additional Relief, Donald J Trump v. United States, No. 9:22-CV-81294-AMC (S.D. Fla. Aug. 30, 2022) (ECF No. 48 at 5- 13), as well as any matters that arose or may arise directly from this investigation or that are within the scope of [Special Counsel Regulation 28 C.F.R. 600.4(a)].

                              The Trump Mar-a-Lago document investigation (the proverbial nothingburger – just like Trump/Russia) transfers to the Special Counsel office, along with an intended angle to look for an obstruction of justice charge (just like Mueller). This is Robert Mueller 2.0 using Special Counsel Jack Smith.

                              The Trump-centric part of the special counsel appointment, the part that everyone is focusing on, is ancillary to the real purpose of the appointment. However, that said, all investigative resources from Main Justice and the FBI will transfer to Jack Smith as they did when Crossfire Hurricane transferred to Robert Mueller. The investigative people will transfer along with the investigative evidence.
