  • Attacking the court used to be bad

    Source: https://www.brennancenter.org/our-work/research-reports/his-own-words-presidents-attacks-courts

Donald Trump has displayed a troubling pattern of attacking judges and the courts for rulings he disagrees with — a pattern that began during his presidential campaign (and even before), and has continued into his presidency.

This threatens our entire system of government. The courts are bulwarks of our Constitution and laws, and they depend on the public to respect their judgments and on officials to obey and enforce their decisions. Fear of personal attacks, public backlash, or enforcement failures should not color judicial decision-making, and public officials have a responsibility to respect courts and judicial decisions. Separation of powers is not a threat to democracy; it is the essence of democracy.

When a judge who helped derail President Donald Trump’s travel ban was hit with online threats, the abuse raised safety concerns among jurists across the country, and experts are worried that the president’s own attacks on the judiciary could make judges a more inviting target.

U.S. District Judge James Robart imposed the temporary restraining order that halted enforcement of Trump’s ban last week. The president soon sent a tweet saying the opinion of “this so-called judge” was “ridiculous and would be overturned.” He also tweeted that the judge was “a known liberal sympathizer” and had “just opened the door to terrorists!”

Robart quickly became a target on social media. Someone on Twitter called him a “DEAD MAN WALKING” and another on Facebook suggested that he be imprisoned at the military detention center at Guantanamo Bay, “where other enemies of the US are held.”

Just ask U.S. District Judge James L. Robart. After Trump referred to him as a “so-called judge” for granting a temporary restraining order against the president’s travel ban in February 2017, Robart’s personal information was posted on the Internet, and he received more than 100 death threats.

Examples like these highlight an overlooked result of verbal attacks on the judiciary: growing evidence that violence against judges has been increasing in recent years. Although it is difficult to pinpoint why judges are more often being physically threatened, the verbal attacks may well be related.

It all depends on which side is doing it, whether it is good or bad.

An old tradition among Democrats stretching back to one of the party's founders, Andrew Jackson, who sneered, "John Marshall has made his decision; now let him enforce it" in response to the 1832 decision in Worcester v. Georgia (striking down a law in Georgia that placed restrictions on white people entering and exiting Native American land).

I'm actually not totally opposed to the idea of picking a case where a Federal District Court declares its verdict applies nationwide, and just flat out ignoring it if you're not in that district. That kind of overreach needs to be challenged directly at some point.

Packing the supreme court used to be bad too, but I am betting that the DemocRATS will be wanting to do that now in order to grab power back.
