It wasn’t directly constitutional, but rather an ambiguity in the Electoral Count Act intended to resolve disputes when competing slates of electors were chosen. The intention of the J6 plotters was to create competing slates by rejecting the given slates and requiring the states to select new electors. There’s broad agreement that the ECA does indeed need to be rewritten.
