    The plaintiffs have moved the court to preliminarily enjoin the enforcement of two executive orders by the President. The first, Executive Order 14042, is already the subject of a nationwide injunction. Because that injunction protects the plaintiffs from imminent harm, the court declines to enjoin the first order. The second, Executive Order 14043, amounts to a presidential mandate that all federal employees consent to vaccination against COVID-19 or lose their jobs. Because the President’s authority is not that broad, the court will enjoin the second order’s enforcement. The court notes at the outset that this case is not about whether folks should get vaccinated against COVID-19—the court believes they should. It1/20Case 3:21-cv-00356 Document 36 Filed on 01/21/22 in TXSD Page 2 of 20is not even about the federal government’s power, exercised properly, to mandate vaccination of its employees. It is instead about whether the President can, with the stroke of a pen and without the input of Congress, require millions of federal employees to undergo a medical procedure as a condition of their employment. That, under the current state of the law as just recently expressed by the Supreme Court, is a bridge too far.

    The court GRANTS IN PART and DENIES IN PART the plaintiffs’ motion for a preliminary injunction. Dkt. 3. The motion is DENIED as to Executive Order 14042, as that order is already subject to a nationwide injunction. The motion is GRANTED as to Executive Order 14043. All the defendants, except the President, are thus enjoined from implementing or enforcing Executive Order 14043 until this case is resolved on the merits.

    But can the Defense Department make a vaccine requirement on their own as an individual employer? I know that although they blocked the civilian employer mandate, individual employers can still mandate it themselves within their own companies.

      I disagree with the dancing - this is a very mixed outcome.

      I think it is in everyone's best interests that if we work together indoors, we all be vaccinated. It is in everyone's best interests all that can be vaccinated.

      HOWEVER, if the mechanism used to create the mandate is itself unconstitutional, i would agree the court should have ruled against it. We don't want to open the door to unconstitutional rulings by fiat by the president no matter how good the actual ruling might be.

      So I am not dancing for joy, but rather sad that our government is so fractured and our people so misled that a constitutionally sound mandate is probably not possible. The mandate, while it stood, saved many thousands of lives by encouraging greater vaccine participation. That can be seen in the drop pre omicron but post mandate.

      Perhaps soon we will have enough immunity in the country as a whole that not many more need die

          No. They have to have the backing of either Congress or the POTUS if the SCOTUS grants him that authority on appeal.

            We're waiting to find out if this frees my hospice nurse daughter --- they do receive federal funds, and HAD been... she was going to lose her job at the end of the month. Maybe this is a stay of execution, who knows.
            The first to state his case seems right until another comes and cross-examines him.

                Yikes! But as you say none of this any surprise. The real surprise is how very corrupt the CDC, FDA, and whatever clown show Fauci runs are and the complicitness of these agencies in death. It's quite shocking really.
