    The real irony is that firearms like AR-15s were rarely if ever used in the commission of any sort of crimes including murder until the government kept making a lot of noise about them. Immediately afterwards, coincidentally I'm sure, you started seeing a steady increase in their use for such activities.

    US District Judge Roger Benitez of San Diego ruled that the 1989 ban on military-style rifles deprives state residents of their right to bear arms.

    “Under no level of heightened scrutiny can the law survive,” Benitez said.

    “Like the Swiss Army knife, the popular AR-15 rifle is a perfect combination of home defense weapon and homeland defense equipment. Good for both home and battle,” the judge said in his ruling’s introduction.

    No. I think it boils down to the fact that they are locked behind a filibuster wall until they can get the two democrat holdouts to agree to eliminate it. They can't harp on SCOTUS until they have the power to do something about it.

    One of the biggest problems that those who like the "assault weapon" ban has been their difficulty in explaining how they would distinguish between them and your typical semi-automatic hunting rifle. The first and probably the last time they tried, it was based on cosmetic features and that ended in compete failure.
