As soon as Ashli Babbitt went through that window, that was not the case.

I don't see anybody arguing that.

He shot her in the neck.
At close range, he's either a really bad shot, or he accidentally shot her trying to scare her away. Way before he shot her, he can be seen with his finger firmly on the trigger, while others in the room have their trigger finger fully extended alongside the action - which is the proper stance. The first to state his case seems right until another comes and cross-examines him.

From the photo, I can't tell whether his finger is on the trigger, or in front of the trigger guard.

You can also see Babbit climbing through the window - both hands clearly visible from the inside - and she was still shot in the neck.

Not only is his finger on the trigger, his gun is pretty much lined up with the back of one of his own guys.
Look at the other armed officer - the proper stance for an officer in a threat situation.

And, again, there were other officers behind him. Was it you who said he was the only one in the room?
It's not even a room - it's the LOBBY of the room.
