House impeaches Trump again...

    The first to state his case seems right until another comes and cross-examines him.

        I have seen dispute over whether the Senate can ban from holding from office if the target is NOT "removed from office" from the Senate.
        In other words, he would have to be convicted in the Senate by 2/3 vote, and IF that happens, then he can be banned form office by a simple majority.

        We're in uncharted waters here, and I've seen legal experts argue it both ways. ;shrug:
        Only one way makes sense. Unless banning someone from holding office even though that person continues to hold office makes sense.

          Text of the constitution is plain. Takes 2/3 to convict. Barring from holding office is one of two punishments available upon conviction.

                        Yep. NPR was discussing this as well. The barri ng from office is a punishment that can be voted upon after conviction.

                        to go back to my analogy, removal from office and barring from further office are potential punishments: I.e. like sentencing after conviction. One doesnt get to apply punishments before (or with a failure to convict) conviction.

                        so, as you said, 2/3 to convict first, and then they can vote (simple majority)on barring from office if successful.

                          That is my understanding, as well. And our Founding Fathers didn't seem to think that impeachment was something to be used as a political weapon, but in extreme circumstances, and with cooler heads.

                            Our Founding Fathers were also under no illusion that the Constitution would serve as a restraint to people who had lost all sense of reason. As John Adams famously said, "Our Constitution was made only for a moral and religious people. It is wholly inadequate to the government of any other."
