The impeachment resolution the House voted on, which passed 232 to 197, charges Trump with a single article, “incitement of insurrection” for his role in last week’s deadly Capitol riot.

More than symbolism. I understand that if Trump is convicted in the Senate, he can no longer hold public office again, he loses his pension and he loses his Secret Service protection. This is not trivial. The first to state his case seems right until another comes and cross-examines him.

Then there is the 14th amendment as a back up plan for the same outcome.Last edited by oxmixmudd; 01-13-2021, 08:49 PM.My brethren, do not hold your faith in our glorious Lord Jesus Christ with an attitude of personal favoritism. James 2:1

But if Trump actually did get removed before January 20, Pelosi wouldn't become VP. Pence would nominate a VP, to be confirmed by a majority vote of both houses of congress. The first to state his case seems right until another comes and cross-examines him.

Trump, then Pence, Then Biden, and then of course Harris because they're not likely to keep Biden in there for long, especially with the way they've been stressing the 25th Amendment across MSM and in Congress the last few months. My brethren, do not hold your faith in our glorious Lord Jesus Christ with an attitude of personal favoritism. According to the Senate's website, "The Constitution requires a two-thirds vote of the Senate to convict, and the penalty for an impeached official upon conviction is removal from office. In some cases, the Senate has also disqualified such officials from holding public offices in the future."
The second penalty—banning a public figure from running for office again—requires only a simple majority of 51 senators rather than the two-thirds majority needed for removal, according to The New York Times.
Bold mine.
The 2nd penalty is the goal, since removal is redundant.

In other words, he would have to be convicted in the Senate by 2/3 vote, and IF that happens, then he can be banned form office by a simple majority.
We're in uncharted waters here, and I've seen legal experts argue it both ways. ;shrug:
